Arena Careers Terms of Service

This consent, terms, and waiver of liability agreement (“Agreement”) outlines the terms and conditions of Arena Talent Services (“talent services”) and the assumption of any risks involved in my organization’s (“Employer’s”) use of talent services. Arena Talent Services include but are not limited to use of the Arena Talent Bank, posting a job through Arena Careers, receiving personalized resumes, recruiting through an Arena Careers Fair, and Arena employer tools through the Arena Toolbox.

Employer understands that Arena has created talent services for job seekers to submit their resumes and other information for the purpose of obtaining employment. Arena takes reasonable steps to ensure that job seekers submit accurate information through talent services, although Arena does not verify any of the information provided by job seekers, nor take any responsibility if a job seeker has provided inaccurate information.

As a condition of access to talent services, Employer certifies that it is in full compliance with all applicable federal, state, and local laws governing the employment relationship and hiring process. Employer also certifies that it is an equal opportunity employer and does not discriminate against applicants or employees based on any protected characteristic under applicable federal, state, or local law.

Companies posting roles on Arena Careers must certify that they are aligned with the following values: Democracy is a fundamental human right and the 2020 presidential election was not stolen; Climate change is real; Access to healthcare is important; and the government can improve Americans’ lives.

The information and services available on the site are provided for the sole purpose of individuals looking for employment opportunities and career information and for employers seeking to recruit individuals. Contacting job seekers via email or other means, for any reason other than recruitment, is strictly prohibited. Employer also agrees not to share job seeker information with anyone or any entity outside of Employer or for any purpose other than related to recruitment and hiring. To be clear, Employer may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. Employer may not otherwise copy, display, transmit or distribute any material from the site.

Employer understands that Arena is not involved in the hiring process of Employer, nor considered an employer with respect to Employer’s use of talent services, and that it is Employer’s responsibility to carry out such checks and procedures as are necessary to ensure that job seekers are suitable for the job advertised and have the required qualifications and personal characteristics in compliance with applicable laws. Further, Arena does not guarantee any response to Employer from job seekers and expects that Employer will be respectful and professional in its communications with job seekers.

Employer acknowledges that Arena does not guarantee or warrant that talent services will operate error-free or that its servers are free of computer viruses or other harmful mechanisms. In no event shall Arena be liable for any damages whatsoever resulting from the use or inability to use talent services, whether based on warranty, contract, tort, or any other legal theory, and whether or not Arena is advised of the possibility of such damages. Talent services are provided on an “as is” basis without any warranties or any kind. Arena, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose, and non-infringement.

Employer further agrees, to the maximum extent permitted by law, to defend, indemnify, and hold harmless Arena, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal fees, alleging or resulting from (i) any information Employer provides to talent services, (ii) Employer’s use of any talent services content, or (iii) Employer’s breach of these Terms. Arena shall provide notice to Employer promptly of any such claim, suit, or proceeding.

BY SIGNING UP FOR TALENT SERVICES, EMPLOYER ACKNOWLEDGES THAT IT HAS READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND RELEASE AND THAT IT IS VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE ARENA.
